Taylor, Bean & Whitaker was a top 10 wholesale mortgage lending firm. Taylor, Bean & Whitaker closed $35 billion in residential mortgage loans in 2007. The company ceased operations on August 5, 2009 following a suspension by the Federal Housing Administration from making FHA mortgage loans and Ginnie Mae mortgage backed securities the previous day. Two days earlier the FBI had raided the company’s Ocala headquarters. FBI agents had raided the headquarters of Taylor Bean & Whitaker on August 3, 2009 in what appeared to be an investigation related to TB&W’s acquisition of a majority stake in Colonial BancGroup. Taylor Bean & Whitaker had signed a deal on March 31, 2009 to become the majority owner of Colonial BancGroup in a $300 million equity stake. As of August 14, 2009 Taylor Bean & Whitaker ceased business operations and terminated all employees at its Ocala, FL office.

Mortgage Regulations Press Conference 12/18/07 (Part 2 of 2)

Today, Attorney General Martha Coakley filed final, revised mortgage broker and mortgage lender regulations with the Secretary of State and has issued official guidance to the broker and lender community to help them understand and implement the new consumer protection regulations governing mortgage brokers and lenders. The regulations, which take effect on January 2, 2008, codify several forms of mortgage fraud and unfair lending which contributed to the recent meltdown in the subprime market and the resulting foreclosure crisis in the Commonwealth.

FEDERAL HOUSING FINANCE AGENCY FILES MORTGAGE LAWSUIT 9-2-2011

In a move that could either send BAC stock limit down overnight or send it soaring (we are still trying to figure out just what is going on here), the NYT has broken major news that the US is preparing to go nuclear on more than a dozen big banks among which Bank of America, JPMorgan Chase, Goldman Sachs and Deutsche Bank, in an attempt for Fannie and Freddie to recoup $30 billion if not much more.

The lawsuit is expected to hit the docket in the next few days: “The suits stem from subpoenas the finance agency issued to banks a year ago. If the case is not filed Friday, they said, it will come Tuesday, shortly before a deadline expires for the housing agency to file claims.”

FHFA goes hog wild and potentially full retard in suing everyone, or specifically 17 global banks, up to an including such dead men walking as Barclays, RBS and SocGen. Oddly such crony capitalist favorites as Wells Fargo are suspiciously absent: we wonder what the cost of that particular Eureka moment was to the interested party.

“While I believe that F.H.F.A. is acting responsibly in its role as conservator, I am afraid that we risk pushing these guys off of a cliff and we’re going to have to bail out the banks again.”

Either way, come Monday, this will get interesting when already scarce liquidity goes… poof.

Here’s a hint – MERS assigns to Wells Fargo.

Same day, same person, same notary assigns from Wells Fargo to Fannie Mae.

“So Janice works for Franklin American Mort Corp. in Flint, MI and Assigns the mortgage as an Asst. Sec’y for MERS to Wells Fargo in Iowa, and she has the assignment notarized in Dakota County, Minnesota.”

“Then, on the same day, she also works for Wells Fargo in Iowa, and assigns the mortgage to Fannie Mae in Philadelphia, PA and has it notarized again in Dakota County, Minnesota?”

“First, Lets just assume that it’s legal to have an assignment of mortgage from a company in Flint, MI to be notarized in Minnesota for a company located in Iowa. And then let’s also assume that a company in Iowa can have an Assignment of mortgage notarized in Minnesota for a company in PA.”

“Is this sort of behavior legal? Or could it be FRAUD? Hmmmmmm, Flint, MI to Dakota, MN, a mere 581.8 miles apart. That’s nearly a 12 hour drive w/o any highway mishaps, oh, and you better have the ability to walk on water, otherwise, its a 688 mile drive under Lake Michigan and over 12 hours. Typically, banking hours are between 8am & 5pm. That’s a total of 9 hours. Maybe she should have saved gas and just driven to Iowa. It’s only 10 hours away.”

Pretty neat trick huh?

There is something very sinister about this amazing time travel. It is my belief that these individual mortgage obligations live in more than one savvy MBS investor’s “book.” Each manifestation of the obligation is insured against default for the full outcome based appraisal “value.”

Each investor is made whole via insurance and thanks to AIG, who of course was caught by surprise, has no choice but to dump the whole mess on the taxpayer. Meanwhile, the “servicer” purchases (for pennies on the fiat) the right to pursue the extinguished debt and seek as many deficiency judgments as possible.

Not to mention the fact that clear chain of title on millions of homes (in default or not) are destroyed. Further, if the obligations fail to make their way to the trusts within the REMIC window, throw massive tax evasion into the mix.

FHP Trooper arrested for grand theft and mortgage fraud

HUD GIVING $50,000 TO HOMEOWNERS BEHIND ON MORTGAGE 7-5-2011

The Emergency Homeowners Loan Program will offer a zero interest, forgivable bridge loan to homeowners who have experienced a substantial loss of income (a reduction of at least 15%) due to unemployment or underemployment caused by adverse economic conditions or medical condition. Approved homeowners are eligible to receive one-time EHLP assistance to pay certain arrearages to bring them current, as well as ongoing monthly assistance to help them to make their monthly first lien mortgage payments (including payments of principal, interest, taxes, and insurances). Assistance is limited to a maximum duration of 24 months, or up to a maximum loan amount of $50,000 in mortgage payment assistance, whichever occurs first. The EHLP loan is secured by a junior lien against the approved homeowner’s principal residence and is forgivable over a 5-year principal reduction period.

For homeowners–making mortgage payments is a must to keep your house, but if you’re in danger of foreclosure, a new federal program could help. It’s called the Emergency Homeowners Loan Program (EHLP), and it could be the extra push that people need to prevent foreclosure.

Right. What made me actually write this was a number of years ago I had been working with people in foreclosure for years, and it was just a way to let them know what was going to be going on once the foreclosure was filed against them. Now in many cases, these people were already experiencing what was going on.

And again I’ve recently had a friend or two go through foreclosure and I had them collect all of the paperwork that they got from all of the foreclosure guys out there trying to help them sell their house or do whatever it was, and I was surprised at how thin the stack was. This one gal in particular, lives in Scottsdale in a very nice house and she didnt have more than maybe 6 letters. In the past, a couple of years ago, especially at the peak of the market, when somebody was in a foreclosure situation they would have seriously a stack 6 inches thick.

People would be knocking on their door 24 hours a day, calling them, dropping off stuff. There were cars driving by all the time and it really got to be a nuisance. And frankly I think it hurt the home owner and their standing in a neighborhood, with all of that traffic and of course everybody knew that they were having problems. So that is why the report was originally written and why I wanted to talk about it today because of all the foreclosures going on in the market right now.

Now let me ask you a question, you are saying that two years ago if I were in a foreclosure my mail box would be chock-full of marketing products. Youre telling me now that there is virtually none?

Well I think that part of it is that back then there was financing available to be able to come in and refinance the people. I certainly myself did dozens of loans, at least, to bail people out of bankruptcies and foreclosures, and also people had equity back then. Property values were continuing to go up. I forget how many scams I pointed out here in the book, I think there are 18 or something in here, and most of them are essentially people attempting to get your house away from you, either refinance it, sell it for you, take a lease option, there are all kinds of different scams involved, but I think the reason we see so much less of it today is because there is so much less equity. So if you are upside down by $300,000 in your house, i dont care how good of a scammer you are, you are not going to make a lot of money off that.

But there are a couple of scams going on right now that I want to talk about because there are a couple of things that happened just recently that harkened me back to when I first got started in real estate here in Arizona in the late 1980s. I was selling repos for Fannie Mae, Countrywide, and the Resolution Trust Corporation, which was in charge of selling off all of the real estate owned for the 1,800 or so Savings and Loans that failed in the late 1980s early 1990s. I have had it with the way the world is beginning to turn out. The more thing “change” the more they stay the same. If we are to survive as an intact species real-authentic change must occur and that starts simply with the individual whose thoughts & actions will reflect into society and begin to change the whole of humanity, but not before the individual changes themselves. Saying, “I believe” or “I am born again,” or “I am Saved,” is no longer enough we need more then professions by lips. We need actions and change that is permanent, not fleeting and flees at the 1st sign of difficulty or temptation.

The goal of my work is as follows:

1. Shatter the Left/Right paradigm by dismissing any remaining doubt that there is a difference between Democrats/Republicans. They have successful run a train on the American people by playing the old good cop/bad cop routine for years. One side will run as far towards tyranny as the people will allow, only to “Hand the Baton Off” to the other on the far side of the elections.

2. Shatter the paradigm that the Constitution never was relevant & now that the “president” can unilaterally declare a US citizen a terrorist, order his assassination, without judicial review, legislative oversight, or administrative appeal. This is proof that the 5th & 14th Amendment right to life liberty, & property reads as void, and no constitution is worth anything, if one is not alive to enjoy its restraint of the state, period.

3. Shatter the paradigm that we have a functional court/justice (JUST-US) system in the US.

It is an incontestable fact that one become the polar opposite of what they resist to the degree that they hate the object of their scorn. Being consumed with hatred for someone trying to take your freedom is the mirror, exact in every way (but opposite of, think the left hand is the mirror image of the right, but they are not the same) of someone trying to fight for freedom. One is fighting to impose the freedom of the state, the other trying to impose the freedom over the state. There will never be a victory in opposition.
